TORONTO -- A woman whose name was dragged into a human rights hearing at which federal investigators admitted to planting messages on a white supremacist website said she may never know why her Internet account was identified as a source of the postings.

Nelly Hechme said she had encountered "too many roadblocks" in trying to get answers about the apparent hijacking of her wireless connection.

Hechme was stunned last spring when her name was brought up at a long-running hate case against Toronto resident Marc Lemire.

Evidence by Bell Canada before the Canadian Human Rights Tribunal indicated that Hechme's Internet account had been used by a "Jadewarr" to post hate messages during an investigation into far-right websites.

An investigator for the Canadian Human Rights Commission admitted to using the pseudonym "Jadewarr" but said the rights agency had no connection to Hechme, who lived near the commission's offices.


On Thursday, the federal privacy commissioner dropped Hechme's complaint, saying it found no evidence her privacy rights were breached.

Lemire was critical of the privacy commissioner's investigation.

"There was absolutely no mismatch," Lemire said.

"I showed the evidence to the Human Rights Tribunal, and it was compelling enough to issue me a subpoena."

The RCMP has declined to investigate complaints by Hechme and Lemire, apparently on the grounds they have no jurisdiction to do so.



I'd be curious to know what sort of messages where planted on this white pride site at my taxpayer expense.

I've got a question about all this... if the CHRC admits to using the jadewarr name, and Bell says this woman's account had that same name go through her modem,
could it be that the jew controled puppets at the CHRC set out to wardrive someone's internet connection to frame them, and got the wrong person?

It isn't really hacking if it isn't password protected. If her wireless modem gave anyone a connection without requiring authentication it is her own fault.
Still it is not right to lie about it...

Agreed. It was also unlawful and criminal charges should result.

Definition of "telecommunication"


(2) In this section and section 327, "telecommunication" means any transmission, emission or reception of signs, signals, writing, images or sounds or intelligence of any nature by wire, radio, visual or other electromagnetic system.

That seems kind of meaningless to me. Do I have the right to consume Oxygen (a gas) because it is in the atmosphere and I need it to live? Do I have the right to consume radio or television broadcasts? They are being sent out but I do not have a license to receive them. Just because this moron did not know how or did not choose to protect her wireless doesn't mean it is illegal to use it. If you live on a hill and put in a sprinkler system that causes a stream to form and run through my property below am I prohibited from harvesting that water?

The access was not fraudulently obtained, her modem happily gave it away as it was set to do. It does not appear that it was malicious although it wasn't too friendly, they posted on a website that was somewhat unseemly but they did not use anything that identified her as the originator specifically, her open net providing plausible deniability. What is color of right, then? She may not have intended to let other people access her network but should we assume that she did not?

I've done my fair share of wifi leeching, I know what you're saying, but your argument is as weak as saying that
if I left my car running, keys in it, top down, and some person drove it away its not theft... it's invitation for free usage.

That analogy is not particularly good anyway. Is it illegal to listen to somebody's baby monitor if you are walking by with a walkie talkie that happens to operate on the same frequency?.

That boils down to intent doesn't it? Intent is everything in criminal law. The term for it is mens rea

To stumble across a conversation has no element of mens rea... just like walking down the street and looking into a livingroom with open curtains.
The moment I walk up to the window with the INTENT to look into it, I might be charged with being a peeping tom.

mens rea is everything when actus reus is also present.
