In law it’s called the principle of nemo dat, nemo dat quod non habet, and it means exactly what the title says.

Just a few days ago the Supreme Judicial Court for the Commonwealth of Massachusetts finally handed down a ruling in a long awaited case called Bevilaqua v. Rodriguez. This case is very important because the Supreme Court ruled in favor of a good title holder over a “good faith purchaser”. Read that again and sit back and let it sink in for a few minutes.

While the entire case is not yet available, or least I could not find it, the Court requested Amicus Briefs before making their decision and those are online on the Massachusetts public access page for that case. The Levitin Brief is the one to read, it was written by four law professors including Christopher Peterson who is quite the authority on mortgage lending.

In 2010, Mr. Peterson wrote a dissertation on MERS that has been quoted repeatedly in lawsuits involving MERS foreclosures. (That MERS report was a great read wherein he skewers MERS for having no authority to do any of the things they have done – ever! I will try to locate the .pdf file in my legal archives and upload to this blog in case any one would like to take a look at it.)

The Levitin Brief is only 21 pages, but you don’t even need to read all of them. The meat is on pages 5 – 13, and let me tell you it is juicy meat! These professors didn’t pull any punches, as you can see from this quote from page 8 of the Brief:

“…U.S. Bank, N.A., was no more capable of passing on good title to the Rodriguez property than a common thief.”

How’s that for truth?

Huge numbers of people were foreclosed on in the past few years, which generally mean a bank repossesses a property, sell it and that's it. Unfortunately, some foreclosed-on homeowners have been finding out that death is just the beginning, struggling with “zombie titles,” where the bank never sells the house. I think it would be more accurate to say the bank merely takes possession of the property. It cannot repossess what it didn't possess in the first place.

Are we missing the boat re what a foreclosure is?
Bank can only foreclosing on the mortgage, not the home. After they foreclose on the mortgage they do a 'forcible detainer action' to create a default so they have legal force to threaten people into voluntarily abandoning the property they already own.
Even the Mortgage agreement says you owned the house, because it is IMPOSSIBLE to get a mortgage on a home you don't already own. That is the initial fraud, but there are many more in the mortgage. Which gives one recourse for canceling the mortgage:

1. Any process re mortgages FIRST needs a CORRECTION of OUR original mistake. e.g. amend the existing indentures of the original promissory note & mortgage (because of fraud & mistake) to create an equity interest receivable that can be used to credit our P-Note against?
2. Another ethical problem is what of the guilt of the one who went to the bank to voluntarily sign up for the death pledge (mortgage)? -- 10 min summary: Banking 201 - Partners in Crime (ie Particeps Criminis) http://youtu.be/9Kyb049v8vI Thus the reason we need to correct our original mistake, get clean hands, and do equity so we can receive equity.
3. Another problem is: any money deposited in a bank, or created using the limited liability insurance # (SSN) is a creation by you as trustee to the public trust... making the money public funds. In other words that is PUBLIC money, not ours, which means we are only Trustees of the debt and abandon our equity interest by participating in this indentured servitude franchise voluntarily. maybe the problem isn't foreclosures... but the original mistake that caused all other mistakes? The First Cause - one's entry point into the Matrix - the Registration of Birth... the Certiificate as evidence of what parents gave as info about that event.

are you still a child?
did you give the information on the Birth Record?
did you correct the mistake after you were 18?
Have you communicated with the Registrar who is maintaining a mistaken record to CORRECT THE MISTAKE?
Do you really believe your parents (earthly mother and father) created you? They gave you the ability to have consciousnesses above the level of animals? You think you parents gave you life? Who created them? Who created the DNA code that gave you self-awareness/consciousness?

What if there is a mistake in the RECORD of the Registry? That identifies the NAME as a 'child'? And the Father is incorrect?

Who Created whom? Who is the author of our consciousness that makes us NOT animals? Your birth parents created your consciousness?

You a Son of God, or Caesar's birth certificate extract out of the REcord of the Matrix? You a slave, or a thinking "I Am" Son of God, made in the image of the Creator? Who is your Father? The one who gave you self-awareness, or your biological father?

You think there is no God? Isn't the fact you can make such a statement, as a free-will choice of consciousness that one is NOT an animal? Are you a slave? Or a servant... of the One who caused the programming that made self-awareness possible? i.e. a Creator? If one is no longer a child, but a Son of God... than to whom does one owe allegiance?

So you going to let the FALSE record stand, in the Matrix (registry)?
