Phoenix, AZ:
Election officials on Tuesday affirmed that proponents of a statewide ballot measure to allow for authorized patients to possess and purchase medical cannabis from state-licensed facilities has qualified for the 2010 November ballot.

Under the proposed measure, state-registered patients would be permitted to obtain cannabis legally from licensed dispensaries. Authorized patients who do not have a facility in their local area (defined as within 25 miles of their residence) would be permitted under the law to cultivate their own cannabis for medicinal purposes. Other patients would not be allowed to grow their own marijuana.

The ballot measure is sponsored by the Arizona Medical Marijuana Policy Project, an affiliate of the Marijuana Policy Project.

The big test will be seeing if the voters vote for it. I would just love to see the AZ Sheriffs having to eat crow and let patients have their medicine. Big Grin

AZ is a strange state when it comes to pot decriminalization...
The voters have passed decriminalization and medical legalization twice, but the state and local governments basically just ignored it and continued acting like fucking Nazis. The poor voters tried to put it back on the ballot in 2004 combined with harsher punishments for other drugs or DUI, but the law enforcement lobby combined with MADD put an alternative measure on the ballot with similar wording, but imposing even stricter marijuana punishments then they already had. The law enforcement initiative passed, and the sane measure didn't.

A first offense possession charge (under a 1/4 oz, I think, including the bag itself,) will usually be dropped by prosecutors, but if its combined w/ any other offense (including paraphernalia), or if you've had anything before that gets up to the misdemeanor level or higher, a positive blood test or a seed on the floorboard of your car will put you under state mandatory minimum sentencing requiring a $1500 fine. Obviously, it gets worse with more. Contrary to belief from outside the state, possession and possessionn with intent to sell are handled within the state, I don't think they go Fed unless you get into trafficking charges

I was very happy the day I looked through the rear-view at the place as I passed into NM for the last time. It's a shame - it's such a beautiful state, and, in certain sectors, it's filled with decent, progressive people. It's not really fair that its been taken over by the Texan mindset.
