Trust me, this lawsuit is no small matter. Nor is the cost. Initially estimated at $100,000 – we simply have no idea what the actual total cost will be. But it is not cheap to sue the US government that makes their money out of thin air and pays their attorneys with your income tax dollars.

I know not how you may decide but for me: Give me Liberty Dollars – or give me death. That guy's argument is that the law allows him to do whatever it is he is doing. In other words, it's black and white. That means it's a prima facie case. When you have a prima facie case, you file a motion for summary judgment or judgment as a matter of law. End of story. There is no jury trial, no taking of 3000 hours of depositions or anything else.
Rule 56 of the Federal Rules of Civil Procedure allow the filing of a motion for summary judgment 21 days after the defendant(s) have been served. Since the government has 60 days to answer a complaint, that might be kind of pointless, but as soon as the government answers, he ought to be filing a motion for summary judgment.
If he doesn't or can't, then he's full of shit. Anyway, his attorney's fees shouldn't be more than $8,000 to $10,000, not the $100,000 he's claiming.
What he is doing is NOT illegal. Libertydollar does not claim and has never claimed to be legal tendar. It is a barter system of trade. It has been around for 7 or 8 years now. The fed alreayd has stated it is legal.

The US government has been served and we have our first firm date. The government must reply by May 25, as they have 60 days from date of service.
Immediately following the government’s reply, which we anticipate will be a denial, the judge will call a Scheduling Hearing with the opposing attorneys and layout the schedule for discovery, briefs, orals, with his decision to follow. Given that each of these four steps will take 30 days, plus the two months the government has to reply, means we will not have a decision until September 25. It is also given that the judge will take 30 days to render his decision. This is just over a year since the US Mint posted their warning on September 13th and just a week shy of our 9th Anniversary on October 1. Interesting timing.
Of course, another six months is a hell of a long time for the Liberty Dollar to hold its breath. As you are probably aware, we are struggling against less demand for Liberty Dollars and more legal expenses.
