See...no justice in courts these days. The judge leads the jury to not be able to render the correct verdict and justice is raped. This is just the precedent for getting the cops off the hook when they get trigger happy and shoot an innocent person in the wrong place at the wrong time. No police officers will face charges over De Menezes shooting, CPS announces

The decision, which follows a review of evidence from his inquest, angered the family of Mr de Menezes, 27.

The innocent Brazilian was shot at Stockwell Tube station in South London after being mistaken for one of the failed 21/7 bombers.

In December, an inquest jury returned an open verdict - rejecting the police view that he was killed lawfully.

Police said they had shouted a warning to him but he continued moving towards them. Tube passengers disputed this.

Banned by the coroner Sir Michael Wright from returning a verdict of unlawful killing, the jury was nevertheless highly critical of the Met's attempts to prove that the victim had been lawfully killed.

Mr de Menezes's family were furious at what they described as 'a complete whitewash' by the coroner and demanded charges be brought.

Yesterday Mr de Menezes's cousin Vivian Figuierdo said: 'We cannot understand how the deliberate killing of an innocent man and an attempt by the Metropolitan Police to cover it up does not result in a criminal offence.'

But CPS lawyer Stephen O'Doherty said there was insufficient evidence that any offence was committed by any individual officers in relation to the tragic death of Mr de Menezes.

'I concluded that in the confusion of what occurred on the day, a jury could not be sure that any officer had deliberately given a false account of events.'

The CPS first ruled out criminal charges in 2006. The Met was instead fined £175,000 under health and safety laws.

His comments came as he published his recommendations to Scotland Yard and the Home Office on the case following a three-month inquest last year.

He said it had become clear that officers had been allowed to work on their accounts together "for a period of many hours".

"There was a stark difference between their experience and the treatment of civilians, who were required to give their accounts promptly and independently," he said.

"Officers were not cross-examined on the basis that their evidence was the product of independent recollection."

Mr de Menezes was shot dead following a mix-up as police pursued suspects following a failed series of bombings in the capital the previous day.

The inquest jury returned an open verdict on the shooting after Sir Michael ruled out the possibility of finding unlawful killing.

But they rejected officers' evidence that they shouted "armed police" before opening fire and disputed that the Brazilian had walked towards officers before he was killed.

Sir Michael said that the "unprecedented" situation faced by officers, after the failed bombings the day before, offered some explanation for the shooting.

But he said that the verdict nevertheless pointed to "systematic failures" and called for procedures on how information identifying suspects is passed on to be reviewed.

Nick Hardwick, chairman of the Independent Police Complaints Commission, called for "determined and continuing efforts" to prevent a repeat of the failures which led to the tragedy.

The Justice4Jean campaign group said a public debate about what it called the "shoot-to kill policy" is long overdue.

My opinion is that we really need to start discussing how to amass our data in a succinct form with corroborating proofs in a way that it can work as an outreach to those already concerned about state abuses but compromised in free thought due to the 'anti semitic' bluff - and the comparative of islam to, for that matter

The final insult: How family of innocent Brazilian shot dead on Tube will get just a fraction of £400k pay-off for blundering Met boss Blair

Lawyers for Scotland Yard and the family are believed to have reached an out-of-court settlement.

Although the amount is covered by a confidentiality clause, sources said it would have been much higher if Mr de Menezes, 27, had left a widow and children or came from a wealthy family.

But when he died in 2005, his parents were living in a dilapidated one-bedroom house deep in the Brazilian rainforest.

The family's lawyers had suggested they would claim £300,000 from the Metropolitan Police for the disastrous operation that led to their son being mistaken for a suicide bomber and shot seven times in the head at Stockwell Tube station.

But it now appears the final pay-out could be as low as £100,000.

That represents just a quarter of the £400,000 pay-off received by former Met chief Sir Ian Blair, who faced calls to resign over the shooting, was condemned by the Independent Police Complaints Commission and heard his marksmen branded liars by an inquest jury.

It is even less than police paid out 23 years ago to an innocent man severely wounded by armed officers in similar circumstances.

The parents of Stephen Lawrence received £300,000 in compensation for the police blunders that left his killers free and Colin Stagg was paid £706,000 in state compensation - not by the police - after years of being wrongly suspected of murdering Rachel Nickell on Wimbledon Common.

The de Menezes family have so far received £15,000 from Scotland Yard to cover flying their son's body home and his funeral.

As he was not officially the victim of a crime, they are not entitled to criminal injuries compensation.

Negotiations on a final payment began last week and a deal is expected to be confirmed in the next few days.

Meanwhile Sir Ian, who was condemned by the IPCC for blocking their investigation of the shooting for five days, is also set to make a six-figure sum from his memoirs, in which he comments at length on the case.

In an interview to promote the book, he suggested that had the two marksmen not killed the wrong man, they could have been candidates for George Medals.

Mr de Menezes was shot dead on July 22, 2005, after anti-terror police mistook him for bomber Hussain Osman.

Osman and four fellow terrorists had gone on the run the previous day after trying to copy the July 7 London attacks which killed 52 people and injured 977.

At the inquest on Mr de Menezes last December, the jury pointed to a catalogue of police failings.

They rejected the marksmen's evidence and sided with Tube passengers who said the officers failed to issue a warning. The policemen's claim that Mr de Menezes walked towards them was also dismissed.

The jury returned an open verdict, the most critical option available, after the coroner told them there was insufficient evidence to rule that Mr de Menezes was unlawfully killed.

Relatives of the Brazilian called the hearing a 'whitewash' and accused coroner Sir Michael Wright of 'gagging' the jury.

The three-month inquest followed a £300,000 investigation by the IPCC and a £1million trial at which the Metropolitan police were found guilty of health and safety failings and fined £175,000.

Legal costs for the inquest, paid for by taxpayers, are expected to reach £8million.
