Air their 9/11 struggle, kin of jet victims implore judge

The last anguished moments of the doomed passengers aboard United Airlines Flight 93 will be played aloud in a Manhattan courtroom if the relatives of several 9/11 victims get their way.

Family members this week asked a federal judge to play a 31-minute cockpit voice recording for jurors at an upcoming trial. The tape captures the deadly struggle to regain control of the hijacked plane before it crashed into a field near Shanksville, Pa., six years ago.

Dozens of families who opted out of a federal compensation fund are suing the airlines, plane manufacturers, security agencies and the Port Authority for the wrongful deaths of their loved ones in a case scheduled to start next month.

Carole O'Hare says a boiled-down paper transcript of the final minutes of her mother Hilda Marcin's life fails to accurately portray the suffering the 79-year-old New Jersey woman and the others endured.

"My mother and the other passengers on Flight 93 bravely decided, upon learning that other planes had been hijacked on the morning of Sept. 11 and flown into the World Trade Center, to fight back [and] attempt to regain control of the cockpit in order to prevent the destruction of additional U.S. landmarks and the loss of additional lives," O'Hare told Federal Judge Alvin Hellerstein. "This heroic effort and ultimate sacrifice is conveyed in the cockpit voice recording, and the transcript is a poor substitute for the horror and terror they endured in the last 30 minutes of their lives."

O'Hare claims the transcript omits dramatic moments, which she heard when the FBI allowed her and other family members to listen to the recording in 2002.

O'Hare said she heard one hijacker tell another to "finish her off."

"There were also a series of cabin bells chiming constantly and the sound of a female flight attendant crying and struggling and verbally pleading for her life from the cockpit," O'Hare wrote. "Later there is a gurgling sound of blood from the same female flight attendant."

Marcin, who had recently retired from her job as an aide at a school for special education students, was traveling from her home in Budd Lake, N.J., to visit her daughters in northern California. The children were planning a surprise birthday party for December 2001.

The plaintiffs include families of victims on all four planes that crashed on 9/11.

During the first phase of the trial, jurors will decide damages in an unusual setup that Hellerstein hopes will jump-start settlement talks. Typically, jurors would decide whether the defendants bear liability for their actions before deciding how much money they should pay out.

The cockpit voice recording was played at last year's trial of terrorist Zacarias Moussaoui in Virginia, but it has never been publicly aired. Moussaoui was convicted, and the judge in his case cited the pending federal investigation of the crash as reason to prevent the public release of the recording.

Michael Elsner, a lawyer for the families, said that issue has become moot because the probe has ended.
