judge rules indefinite detention violates the Constitution. (Update: Not Anymore!!)
Even if it does nothing in the long run and seems like fodder for people who shield their eyes from what´s actually going on in the world, it´s nice to occasionally hear good news:
(via email)
Quote:...Chris Hedges, Revolution Truth, et al won their lawsuit last week as a judge ruled that indefinite detention violates the Constitution.

More than 50,000 Demand Progress members have signed on as supporters of the lawsuit.

Now indefinite detention is back in President Obama's hands: He can tell the government's lawyers not to appeal the ruling and put an end to this travesty once and for all.

Meanwhile, the Senate takes up indefinite detention THIS WEEK.

Please click here to urge Obama to stop supporting indefinite detention and to tell your senators to oppose indefinite detention...

Quote:...Obama signed last year's National Defense Authorization Act even though it included provisions which could let the military detain civilians indefinitely without a trial or charges.

Despite a valiant effort by opponents, the House retained indefinite detention when it passed the new NDAA last week.

The Senate will take it up soon, and President Obama can drop his defense of it in court.

Please click here to email Obama and the Senate right away and help us save our civil liberties.

Let's keep fighting.

I don't want to trivialize the importance of this news, but I think USAnians have a very long way to go before they get back to the level they were at prior to 9/11. It seems like the pricks calling the shots are pushing them two steps back for every one step forward... or maybe it's more like they're delivering five vicious uppercuts causing them to lunge back for every tiny stagger forward.

Time for the revolt to commence! Pick up torches and pitchforks and march on city hall immediately! Take over all local buildings. Empty the prisons of nonviolent offenders and fill them with politicians and banksters! Start building gallows. Hang them all and burn their corpses in the town square while dancing around naked howling at the moon! You'll feel better in the morning!

It certainly would beat the hangover I get from drinking nights away waiting and wondering when someone else is going to start it. Only problem is that mobbing town hall won´t solve the conundrum. The fucking fascists rule from seats of power without political boundaries... How would one mob the IMF, WTO, World Bank, etc.?

As for the first paragraph, I agree completely... In fact I think that the USA as instituted initially is long dead - there is no going back. There´s no elevator in this fucking ivory tower... if people want to leave the top they´re going to have to tear the motherfucfker down... Now, if only we could reach the foundation...

Federal Judge Kathryn Forrest just rejected the Obama administration's request that she reverse her ruling against indefinite detention.

I agree, Yeti. I personally think we need a grand scale Shay's Rebellion. Wonder what happens when the Anarchists are no longer some thug punk pigs there to make the whole protest seem violent, but are real hard-core anti-authoritarian people with messages and molotovs? My guess is those fat pigs with their radar guns suddenly lose their 'bravery' and 'courage', and those that do not see what happens when you defend a crushing dinosaur of a system. While all that might be a nice thought, it is sadly just that. If people planned on revolting, they would have by now. So long as the TV stays plugged in, and the KFC is still there, they will not do a thing. So long as they still have government there to feed them...

They surely will not do a thing.

On the note of the subject of the thread, I personally was more happy when the FDA rejected "Corn Sugar" being the new name for HFCS. The reasoning is this: HFCS industry will not defy the FDA on this issue, but the government will go over this judge like we step over a puddle of water. It is nice, though, to hear some judges still have sense.

RE: judge rules that indefinite detention violates the Constitution.
Court Says Obama Administration Can Still Detain Anybody Indefinitely

Today an appeals court ruled the U.S. can enforce the National Defense Authorization Act's indefinite detention clause while the court decides whether to kill or allow the provisions, Josh Gerstein of Politico reports.

A three-judge motions panel of the U.S. Court of Appeals for the 2nd Circuit concluded "the public interest weighs in favor of granting the government's motion for a stay [i.e. suspension]."

Last month District Judge Katherine Forrest permanently blocked the NDAA, but the Obama administration has appealed her ruling.

Appeals Court Judges Denny Chin, Raymond Lohier, and Christopher Droney agreed with the government that the plaintiffs – journalists and activists – "are in no danger whatsoever of ever being captured and detained by the U.S. military" because the NDAA doesn't "affect the existing rights of United States citizens or other individuals arrested in the United States."

The plaintiffs had successfully argued to Judge Forrest that some provisions of the indefinite detention clause are so vague they would chill free speech and restrict the ability to associate with people the government doesn't like.

The NDAA allows the government to indefinitely detain anyone who provides "substantial support" to the Taliban, al-Qaeda or "associated forces."
